TakeMoreCalls provides AI-powered phone answering and reception services for businesses. We set up, configure, and maintain voice AI systems that answer calls on behalf of our clients. 3. Eligibility

You must be at least 18 years old and able to enter into legally binding contracts to use this Service. By using the Service, you represent and warrant that you meet these requirements.

4. User Accounts and Registration

To use certain features of the Service, you may be required to provide information about yourself and your business. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account.

5. Service Terms

5.1 Setup and Configuration

We will work with you to configure the AI voice system for your business. Setup details, timelines, and specifications will be discussed during consultation and confirmed in writing.

5.2 Service Availability

While we strive to provide reliable service, we do not guarantee uninterrupted or error-free operation. We are not liable for service interruptions due to factors beyond our reasonable control, including but not limited to third-party telecommunications failures, internet outages, or technical issues with underlying AI platforms.

5.3 Your Responsibilities

You agree to:

  • Provide accurate information about your business for AI configuration
  • Respond to our setup and maintenance communications in a timely manner
  • Use the Service only for lawful business purposes
  • Not use the Service to engage in harassment, fraud, spam, or illegal activities
  • Comply with all applicable laws and regulations

6. Payment Terms

6.1 Fees

Service fees will be discussed during consultation and confirmed in writing before service begins. Pricing is typically structured as a monthly subscription based on call volume and configuration needs.

6.2 Billing

You agree to pay all fees associated with your Service plan. Payment terms and methods will be specified in your service agreement.

6.3 Late Payments

Late payments may result in service suspension or termination. We reserve the right to charge interest on overdue amounts at the rate of 1.5% per month or the maximum rate permitted by law, whichever is lower.

7. Cancellation and Termination

7.1 By You

You may cancel your service at any time by providing written notice. Unless otherwise specified in your service agreement, cancellations will be effective at the end of your current billing period. No refunds will be provided for partial billing periods.

7.2 By Us

We reserve the right to suspend or terminate your service immediately if:

  • You fail to pay fees when due
  • We determine that your use of the Service is harmful to us, our systems, or other users
  • We are required to do so by law
  • We decide to discontinue the Service (with reasonable notice)

7.3 Effect of Termination

Upon termination:

  • We will discontinue forwarding calls to the AI system
  • You remain responsible for all fees incurred prior to termination
  • We may delete your account data after a reasonable period

8. Intellectual Property

The Service, including all software, technology, content, and branding, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

8.2 Your Data

You retain ownership of any data or content you provide to us. By using the Service, you grant us a limited license to use this information solely for the purpose of providing the Service to you.

9. Disclaimers and Limitations of Liability

9.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The AI will handle all calls perfectly or without any errors
  • Any information or data will be accurate or reliable

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

9.3 AI Limitations

You acknowledge that the Service uses artificial intelligence technology, which may occasionally produce errors, misunderstandings, or unexpected responses. We are not liable for:

  • Any miscommunication or errors by the AI system
  • Lost business opportunities due to AI errors
  • Decisions made based on AI-generated information
  • Any consequences of AI interactions with your customers

You are responsible for monitoring the Service and implementing appropriate business processes to handle critical situations.

10. Indemnification

You agree to indemnify, defend, and hold harmless ZT Direct LLC, its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your violation of these Terms
  • Your use of the Service
  • Your violation of any rights of another party
  • Any content or information you provide to the Service

11. Third-Party Services

The Service may integrate with or rely on third-party services, including but not limited to AI platforms, telecommunications providers, and business software. We are not responsible for any third-party services, and your use of such services may be subject to separate terms and conditions.

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

12.2 Informal Resolution

Before filing a claim, you agree to contact us at info@takemorecalls.com to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

12.3 Arbitration

If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall be conducted in California.

12.4 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, and there shall be no right or authority for any dispute to be arbitrated on a class-action basis.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website with a new "Last Updated" date
  • Sending you an email notification (if we have your email address)

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
